In a recent issue of this journal, Gamble and Saad offer a taxonomy of conscientious objection in health care with the aim of increasing the common ground in the debate over conscientious objection to prevent parties from talking past each other and help facilitate greater progress on this issue. Although we agree that this is an important and worthwhile project, Gamble and Saad's proposal suffers from several serious weaknesses that limit its ability to do the work set out for it. (...) In this paper, we identify some of the major problems with this particular attempt in order to highlight some desiderata for a taxonomy of conscientious objection in health care that can serve as a guide for developing improved taxonomies of this kind in the future. In an opinion piece penned at the Great War’s onset yet apparently unpublished until now, the historian of religion Hermann Gunkel outlined the opportunities he saw for the German people in anticipation of their triumph. He believed this war could consummate what the Napoleonic Wars and the Unification of Germany had not. Gunkel hoped for true German unity, more liberal domestic politics, and spiritual restoration. Further still, he referred to a resurgence of piety on account of the conflict. On the (...) Great War’s centenary, this documentation speaks to the mobilizing, nationalist activities of Gunkel in particular and of academicians and theologians more generally. (shrink)

Philology haunts the humanities, through both its defendants and its detractors. This article examines the construction of philology as the premier science of the long nineteenth century in Europe. It aims to bring the history of philology up to date by taking it seriously as a science and giving it the kind of treatment that has dominated the history of science for the last generation: to reveal how practices, instruments, and cooperation create visions of timeless knowledge. This historical inquiry therefore (...) asks how one modality of textual interpretation could morph into an integrated system of knowledge production, which ostensibly explained the whole human world. Ultimately, it advances a central argument: philology operated as a relational network, one that concealed diversity and disunity, projected unity and stability, and seemed to rise above the material conditions of its own making. The article scrutinizes the composition of philology as a heterogeneous ensemble, the functioning of philology comparable to other sciences, whether human or natural, and the historical contingency in the articulation of philology. This handbook was created in cooperation with an international research team. It presents Broch s life history along with all of his literary and essayistic output, analyzing and reassessing Broch s work in its multiple contexts.".

Michael Potts, Paul A. Byrne, an David W. Evans are critical of donation after cardiac death (DCD). Contrary to the authors’ assertion that the removal of vital organs is the proximate cause of death, the eventual fulfillment of the neurological criteria of death is solely dependant on the rate of brain cell death in the absence of circulation. Consistent with the “dead donor rule,” DCD is not the cause of death. There are also procedural mechanisms to address (...) the potential conflicts of interest that concern the authors. Rather than being prohibited, DCD may be an ethically justifiable exception to the rule that organ donors must be dead prior to organ recovery. (shrink)

In response to recent proposals to utilize artificial intelligence (AI) to automate ethics consultations in healthcare, we raise two main problems for the prospect of having healthcare professionals rely on AI-driven programs to provide ethical guidance in clinical matters. The first cause for concern is that, because these programs would effectively function like black boxes, this approach seems to preclude the kind of transparency that would allow clinical staff to explain and justify treatment decisions to patients, fellow caregivers, and those (...) tasked with providing oversight. The other main problem is that the kind of authority that would need to be given to the guidance issuing from these programs in order to do the work set out for them would mean that clinical staff would not be empowered to provide meaningful safeguards against it in those cases when its recommendations are morally problematic. Recognizing the potential hidden artistic contributions of persons with dementia opens new opportunities for interpretation and potential communication. This visual essay explores the authors’ responses to the fragile objects of art produced by a person with severe dementia and examines what may be learned from them.

Richard Heck, in "The Sense of Communication" (Mind, 104, pp. 79-106, 1995), argues against the "Hybrid View"--the claim, roughly, that names are Millian while beliefs are Fregean. We argue that Heck's argument fails.

Martin Heidegger is, perhaps, the most controversial philosopher of the twentieth-century. Little has been written on him or about his work and its significance for educational thought. This unique collection by a group of international scholars reexamines Heidegger's work and its legacy for educational thought.

Traditional whistleblowing theories have purported that whistleblowers engage in a rational process in determining whether or not to blow the whistle on misconduct. However, stressors inherent to whistleblowing often impede rational thinking and act as a barrier to effective whistleblowing. The negative impact of these stressors on whistleblowing may be made worse depending on who engages in the misconduct: a peer or advisor. In the present study, participants are presented with an ethical scenario where either a peer or advisor engages (...) in misconduct, and positive and the negative consequences of whistleblowing are either directed to the wrongdoer, department, or university. Participant responses to case questions were evaluated for whistleblowing intentions, moral intensity, metacognitive reasoning strategies, and positive and negative, active and passive emotions. Findings indicate that participants were less likely to report the observed misconduct of an advisor compared to a peer. Furthermore, the findings also suggest that when an advisor is the source of misconduct, greater negative affect results. Post-hoc analyses were also conducted examining the differences between those who did and did not intend to blow the whistle under the circumstances of either having to report an advisor or peer. The implications of these findings for understanding the complexities involved in whistleblowing are discussed. (shrink)

Many jurisdictions have put regulatory strategies in place to provide incentives and safeguards to whistleblowers to encourage whistleblowing on corporate wrongdoings. One such strategy is the provision of a financial incentive to the whistleblower if the complaint leads to a successful regulatory enforcement action against the offending organization. We conducted an experiment using professional accountants as participants to examine whether such an incentive encourages potential whistleblowers to report an observed financial reporting fraud to a relevant external authority. We also examine (...) the effect of perceived seriousness of the wrongdoing on accountants’ intention to whistleblow. We find that a financial incentive results in a higher intention to whistleblow to a relevant external authority. We also find that perceptions of the seriousness of the wrongdoing are significantly and positively associated with accountants’ intention to whistleblow to a relevant external authority. We find a significant interaction between the provision of a financial incentive and the perceived seriousness of the wrongdoing on the intention to report the wrongdoing externally. The intention to report the financial reporting fraud externally is higher when the level of perceived seriousness is higher, regardless of the availability of a financial incentive. However, when the perceived level of seriousness is lower, the presence of financial incentive results in a higher intention to report the financial reporting fraud externally. These findings indicate that the impact of a financial incentive on the intention to whistleblow is moderated by perceptions of the seriousness of the wrongdoing. (shrink)

Qualia internalism is the thesis that qualia are intrinsic to their subjects: the experiences of intrinsic duplicates have the same qualia. Content externalism is the thesis that mental representation is an extrinsic matter, partly depending on what happens outside the head. 1 Intentionalism comes in strong and weak forms. In its weakest formulation, it is the thesis that representationally identical experiences of subjects have the same qualia. 2.

Over 90% of the organs transplanted in China before 2010 were procured from prisoners. Although Chinese officials announced in December 2014 that the country would completely cease using organs harvested from prisoners, no regulatory adjustments or changes in China’s organ donation laws followed. As a result, the use of prisoner organs remains legal in China if consent is obtained. We have collected and analysed available evidence on human rights violations in the organ procurement practice in China. We demonstrate that the (...) practice not only violates international ethics standards, it is also associated with a large scale neglect of fundamental human rights. This includes organ procurement without consent from prisoners or their families as well as procurement of organs from incompletely executed, still-living prisoners. The human rights critique of these practices will also address the specific situatedness of prisoners, often conditioned and traumatized by a cascade of human rights abuses in judicial structures. To end the unethical practice and the abuse associated with it, we suggest to inextricably bind the use of human organs procured in the Chinese transplant system to enacting Chinese legislation prohibiting the use of organs from executed prisoners and making explicit rules for law enforcement. Other than that, the international community must cease to abet the continuation of the present system by demanding an authoritative ban on the use of organs from executed Chinese prisoners. (shrink)
